Herculean
Application terms of use
Terms governing use of the Herculean application and its integrations.
Last updated: 13 October 2026
These terms govern your use of the Herculean application and its integrations (the Application). By creating an account or using the Application, you agree to these terms. If you do not agree, do not use the Application.
The Application is operated by Truly Digital Ltd, trading as Herculean, a company registered in England and Wales under company number 09206603. Its registered office is 86–90 Paul Street, London, EC2A 4NE, United Kingdom.
Herculean is currently under active development. Features, availability and these terms may change as described below.
Your account
You sign in using Google as an identity provider. You must provide accurate account information, use a Google account you are entitled to use and keep that account secure. You are responsible for activity performed through your Herculean account unless it results from something for which Herculean is responsible.
Tell us promptly if you believe your account has been accessed without permission. You may not share access in a way that bypasses account, security or usage restrictions.
What the Application does
Herculean stores and organises information you choose to provide, including projects, tasks, descriptions, labels, priorities, deadlines and related workspace content. It can also make that information available through integrations you choose to connect, including supported AI assistants.
Herculean does not use Google sign-in to access your Gmail messages, Google Drive files, contacts or other Google-account content. Google confirms your identity and supplies limited profile information and authentication credentials. If a future feature requests additional Google access, that access must be presented and authorised separately.
Your content
You retain ownership of content you submit to Herculean. You give Herculean a limited, non-exclusive licence to host, copy, process, transmit and display that content only as needed to operate, secure, support and improve the Application and comply with law. This licence ends when the content is deleted from active systems, subject to reasonable technical retention in backups and any legal obligations.
You are responsible for ensuring that you have the right to submit your content and that its collection and use through Herculean is lawful. Do not submit content that infringes another person’s privacy, confidentiality, intellectual-property or other rights.
Sensitive and high-risk information
Herculean is a personal task and project-management application, not a specialist system for secrets, regulated records or high-risk data. Do not put passwords, private keys, authentication credentials, payment-card data, government identification numbers, medical records, highly confidential business information or other sensitive personal information directly into Herculean.
Where a task needs to refer to sensitive material, keep that material in an appropriately secured specialist service and store only the minimum necessary reference in Herculean. You are responsible for deciding whether Herculean is appropriate for the information you submit.
This warning does not remove any security, privacy or consumer-law responsibility that Herculean is required to meet.
Acceptable use
You must not use the Application to:
- break the law, facilitate unlawful activity or violate another person’s rights;
- store, distribute or direct others to malicious code or unlawfully obtained material;
- harass, threaten, exploit or harm another person;
- gain or attempt to gain unauthorised access to accounts, systems or data;
- probe or test vulnerabilities without prior written permission;
- disrupt the Application, overwhelm it with automated traffic or bypass protective limits;
- impersonate another person or misrepresent your authority; or
- use outputs from an AI integration without exercising appropriate human judgement where an error could cause harm.
We may investigate suspected misuse and preserve or disclose relevant information where reasonably necessary to protect people, the Application or legal rights, or where required by law.
Connected services and AI assistants
You control whether to connect Herculean to a supported third-party service. When you ask a connected AI assistant or other provider to use Herculean, information needed to fulfil that request may pass between Herculean and that provider. The provider’s own terms and privacy policy also apply.
Third-party services may produce inaccurate output, change their integrations or become unavailable. Review consequential actions and outputs before relying on them. Herculean is not responsible for a third party’s independent acts or omissions, but this does not exclude responsibility for Herculean’s own conduct or choice of service providers where the law imposes it.
Availability, changes and beta features
We aim to operate the Application with reasonable care, but do not promise uninterrupted or error-free availability. Maintenance, security incidents, infrastructure failures and changes by connected providers may temporarily affect access.
Because Herculean is under active development, we may add, remove or change features for security, legal, technical or product reasons. Where a material change adversely affects users, we will provide reasonable notice when practicable.
Beta and early-access features may be incomplete, change substantially or be withdrawn. We will identify material limitations we know about where reasonably practicable.
Suspension and termination
You may stop using Herculean and delete your account at any time. If you delete your account, or it expires or lapses under the applicable account or plan rules, Herculean begins deleting the account and its workspace content immediately. There is no dormant-account recovery period. Deletion is permanent, so export anything you need before deleting or allowing the account to lapse. Limited residual copies may remain briefly in technical backups or where retention is legally required, as explained in the application privacy policy.
We may restrict or suspend access immediately where reasonably necessary to address a material breach, security threat, unlawful activity or risk of harm. For less serious issues, we will ordinarily provide notice and a reasonable opportunity to correct the issue. We may discontinue the Application with reasonable notice where practicable.
Privacy and security
Our application privacy policy explains the information Herculean collects, how it is used, where it is processed and the choices available to you.
Herculean uses reasonable technical and organisational measures intended to protect account and workspace information. No internet-connected service can guarantee absolute security. You should keep independent copies of information you cannot afford to lose and avoid using Herculean as the sole record of critical information.
Herculean intellectual property
The Application, software, branding, artwork, design and original materials are owned by Herculean or used with permission and are protected by applicable intellectual-property laws. Except for the limited right to use the Application under these terms, no rights in Herculean’s intellectual property are transferred to you.
Charges and subscription prices
Any paid plan, price, billing period, renewal arrangement, cancellation right and refund term will be shown before you agree to pay. Using an expressly free service does not itself create a payment obligation.
Existing subscription prices
The price shown when you subscribe remains the price for that active subscription. Changes to published prices apply to new subscriptions. We will not increase the price of an existing subscription except in the exceptional circumstances described here.
We may consider an increase only where extraordinary, sustained increases in essential costs of providing the affected plan would otherwise make it loss-making. This may include hyperinflation or extreme increases in the cost of electricity, hard drives, RAM, hosting, computing or data storage. Any increase will be limited to what we reasonably calculate is needed to address those exceptional costs and keep the affected plan from operating at a loss.
If we make such a change, we will give you at least 30 days’ notice before it takes effect. The notice will state the new price and effective date, explain the exceptional cost increases, and show the calculation used to set the new price. The higher price will apply only to a renewal after the notice period; it will not change a billing period you have already paid for. You may cancel before the new price takes effect and will not be charged the higher price. Nothing in this section limits any rights you have under applicable law.
Responsibility when things go wrong
Nothing in these terms limits rights or remedies that consumer law gives you or excludes liability that cannot legally be excluded, including liability for fraud or fraudulent misrepresentation and any liability for death or personal injury that the law does not allow us to exclude.
Herculean is responsible for reasonably foreseeable loss caused by its failure to use reasonable care or by a material breach of these terms. Herculean is not responsible for loss caused by your breach, your decision to submit prohibited or unsuitable sensitive information, a third-party service outside Herculean’s reasonable control, or an event that Herculean could not reasonably prevent.
If you use Herculean wholly or mainly for business purposes, Herculean is not responsible for loss of profit, revenue, business, anticipated savings, goodwill or business opportunity, or for indirect loss that neither party could reasonably foresee when you began using the Application. This business-use limitation does not apply to consumers.
Changes to these terms
We may update these terms for legal, security, technical or product reasons. We will publish the updated terms and revise the date above. We will provide reasonable notice of material changes when practicable. If you do not agree to a material change, you may stop using the Application before it takes effect.
General
If a court or competent authority finds part of these terms unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision does not waive the right to enforce it later. These terms do not give enforcement rights to anyone other than you and Herculean.
These terms and any non-contractual dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, but if you are a consumer living elsewhere, you may also have the right to bring proceedings in your local courts. Your mandatory rights under the laws of the country where you live continue to apply.
